Copyright Infringement Notification & Takedown Procedure

1. Purpose and Scope

BLOXoffice respects the intellectual property rights of others and expects all members and users to do the same. This DMCA Policy explains how BLOXoffice responds to claims of copyright infringement under the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"), and the procedures for submitting and responding to takedown notices.

This Policy applies to all content hosted, streamed, distributed, or otherwise made available through the BLOXoffice platform at bloxoffice.net and any associated applications or services. BLOXoffice qualifies as a service provider under 17 U.S.C. § 512 and maintains safe harbor protections for user-uploaded content, provided that BLOXoffice acts expeditiously to remove or disable access to infringing material upon receiving proper notification.

2. Designated Copyright Agent

BLOXoffice has designated an agent to receive notifications of claimed copyright infringement pursuant to 17 U.S.C. § 512(c)(2):

Notices sent to any address other than those listed above may not receive the protections described in this Policy. Only DMCA-compliant notices submitted to the Designated Agent will trigger BLOXoffice's takedown obligations under 17 U.S.C. § 512.

3. Submitting a Copyright Infringement Notice

3.1 Who May Submit

A copyright infringement notice may be submitted by the copyright owner or a person authorized to act on behalf of the copyright owner. Submitting a false or fraudulent notice is a federal offense. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing is liable for damages, including attorneys' fees.

3.2 Required Elements

To be valid under the DMCA, a takedown notice must include ALL of the following elements:

  • (a) Identification of the Copyrighted Work — A description of the copyrighted work you claim has been infringed.
  • (b) Identification of the Infringing Material — The URL or location on the Platform; the film title, filmmaker name, and/or content ID; and if applicable, the specific portion of content that infringes (e.g., a specific scene, sound recording, or musical composition).
  • (c) Contact Information — Your name, address, telephone number, and email address.
  • (d) Good Faith Statement — A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner's agent, or the law.
  • (e) Accuracy Statement — A statement that the information is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  • (f) Signature — A physical or electronic signature of the copyright owner or authorized person.

BLOXoffice recommends email for faster processing. All notices are logged with a timestamp upon receipt.

4. BLOXoffice's Response to Valid Takedown Notices

Upon receipt of a notice that complies with Section 3, BLOXoffice will:

  • (a) Acknowledge Receipt — Send confirmation within 3 business days.
  • (b) Remove or Disable Access — Act expeditiously to remove or disable access to the allegedly infringing content within 10 business days of receipt of a compliant notice.
  • (c) Notify the Uploader — Notify the filmmaker who uploaded the content that their material has been removed and that they may submit a counter-notification.

4.1 Blockchain-Hosted NFT Assets — Special Considerations

Important Notice Regarding NFT Tickets (Planned Feature): When BLOXoffice mints Non-Fungible Tokens on the Algorand blockchain, certain NFT assets cannot be unilaterally deleted from the blockchain once minted.

Upon receipt of a valid DMCA notice concerning a film for which NFT tickets have been minted, BLOXoffice will take all technically feasible steps within its control, including:

  • Removing the streaming content from the platform (disabling the film's playback)
  • Suspending the film's listing in the primary and secondary marketplaces
  • Freezing new NFT minting for the affected film
  • Disabling platform-level access associated with affected NFT tickets
  • Freezing secondary marketplace activity for affected NFT tickets

BLOXoffice cannot delete existing NFT assets from the Algorand blockchain. However, disabling platform-level access and halting all commercial activity associated with the infringing content represents BLOXoffice's maximum technically feasible response.

5. Counter-Notification Procedure

If a filmmaker or member believes that content was removed or disabled as a result of mistake or misidentification, that person may submit a counter-notification to BLOXoffice's Designated Agent. Submitting a false counter-notification is a federal offense under 17 U.S.C. § 512(f).

5.1 Required Elements of Counter-Notification

  • (a) Description of the material that was removed and its location before removal.
  • (b) A statement under penalty of perjury that the member has a good faith belief the material was removed by mistake or misidentification.
  • (c) The member's name, address, and telephone number.
  • (d) Consent to jurisdiction of the Federal District Court for the member's address (or any district in which BLOXoffice may be found, if outside the US); and acceptance of service of process from the original notifying party.
  • (e) Physical or electronic signature of the member.

5.2 BLOXoffice's Response

Upon receipt of a valid counter-notification, BLOXoffice will forward it to the original notifying party and restore the removed content after 10–14 business days unless BLOXoffice receives notice that the original notifying party has filed a court action.

6. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), BLOXoffice maintains a policy of terminating, in appropriate circumstances, the accounts of members who are determined to be repeat infringers.

A "repeat infringer" is any member who has received two (2) or more valid, uncontested DMCA takedown notices within any rolling twelve (12)-month period, or who has had their content removed pursuant to this Policy on two (2) or more occasions in any rolling twelve (12)-month period.

7. Good Faith Obligations and Abuse Prevention

BLOXoffice takes abuse of the DMCA takedown process seriously. Submitting takedown notices for purposes of harassment, competitive harm, censorship, or in bad faith violates 17 U.S.C. § 512(f) and may expose the submitter to civil liability. BLOXoffice reserves the right to decline to process notices that appear to be submitted in bad faith.

All filmmakers uploading content to BLOXoffice represent and warrant that they own or control all rights necessary to distribute their content on the Platform. Filmmakers who upload infringing content are solely responsible for any resulting claims, damages, and costs.

Nothing in this Policy constitutes legal advice. Copyright law is complex, and the application of the DMCA to any particular situation depends on the specific facts and circumstances. BLOXoffice recommends that both copyright owners and members consult a qualified attorney before submitting takedown notices or counter-notifications.
